Release order, property offences

Andrew Scott Barker, 45, of no fixed address, has been sentenced to time deemed served after pleading guilty to four counts of failing to comply with a condition of a release order; a charge of possessing stolen property of a value not exceeding $5,000, a green Honda TRX400 vehicle; and two counts of possessing stolen property of a value exceeding $5,000, an Arctic Cat Prowler XTX700 vehicle and an orange 2021 Kubota RTV-X1100C vehicle.

Barker changed his pleas to guilty on May 23. After taking credit for time spent remanded in custody into consideration, Judge Del Atwood sentenced Barker to one day in custody deemed served on each of the seven charges.

Without the remand credit, Barker would have been sentenced to three months in custody for each of the release order offences and 12 months on each count of possession of stolen property.

Barker committed the offences in Halifax between Sept. 13 and 16, 2022; in

West Hants between April 1 and 30 and on June 17 and July 14, 2022; and in Windsor on Aug. 24, 2022.

Several other charges were dismissed on May 23. They include two counts of stealing property of a value not exceeding $5,000; possession of stolen property of a value not exceeding $5,000; unlawfully possessing methamphetamine; trafficking in stolen property of a value not exceeding $5,000; two counts of trafficking in stolen property of a value exceeding $5,000; and six more counts of failing to comply with a condition of a release order.

Conditional sentence with house arrest

Adam James Mosher, 36, of Cambridge, Kings County, will serve a period of imprisonment in the community after pleading guilty to distributing an intimate image of an individual knowing that the person depicted did not give their consent; and for failing to comply with probation by failing to keep the peace and to be of good behaviour.

Mosher changed his pleas to guilty on March 13. The matters were adjourned to May 18 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Ronda Van Der Hoek handed Mosher a 60-day conditional sentence order on the two charges. Mosher will serve house arrest for the first 30 days, to be followed by daily curfew from 11 p.m. to 6 a.m. for the remaining time. The conditional sentence will be followed by 18 months of probation.

Mosher committed the offences in Berwick between Oct. 2 and 5, 2021. A charge of criminal harassment was withdrawn on March 13.

Conditional sentence for assault causing bodily harm

Peter Jarratt, 35, of Wolfville, has been handed a conditional sentence order with daily curfew for committing an assault causing bodily harm.

Jarratt changed his plea to guilty on Nov. 7, 2022. The matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

On May 18, Judge Ronda Van Der Hoek handed Jarratt a 30-day conditional sentence order with daily curfew from 10 p.m. to 6 a.m. for the entire time.

Jarratt is to remain in New Brunswick for the duration of the conditional sentence unless written permission to go outside the province is obtained from the court or Jarratt’s supervisor.

Jarratt committed the offence in Wolfville on June 4, 2021.

Impaired driving leads to fine

Norman Bennett, 69, of Spryfield, has been fined for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours of ceasing to operate a conveyance.

Bennett pleaded guilty to the charge on May 18. Judge Claudine MacDonald fined Bennett $2,000 and imposed a one-year driving prohibition against him.

Bennett committed the offence in Greenwich on Feb. 11. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Bennett gave blood alcohol readings of 110 and 110.

A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol was withdrawn on May 18.

Fined for impaired driving

Seth Thomas, 53, of Kingston, has been fined for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours after ceasing to operate a conveyance.

Thomas pleaded not guilty to the charge on Aug. 17, 2021. A trial began on Jan.

18, 2023, and continued April 26. On May 17, Thomas was found guilty.

Judge Ronda Van Der Hoek fined Thomas $1,500 and imposed a one-year driving prohibition against him.

Thomas committed the offence in Kingston on April 4, 2021. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Thomas gave blood alcohol readings of 130 and 130.

Thomas was acquitted on a charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol.

Impaired driving, mischief

Austin Allen Carey, 22, of Sheffield Mills, has been fined for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours of ceasing to operate a conveyance; and has been handed a suspended sentence with probation for committing mischief by willfully damaging an individual’s property to a value not exceeding $5,000.

Carey pleaded guilty to the charges on May 23. Judge Ronda Van Der Hoek fined Carey $1,000 and imposed a one-year driving prohibition against him on the impaired driving charge. Carey was handed a suspended sentence with one year of probation on the mischief charge.

Carey committed the offences in Kentville on Dec.

20, 2022. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Carey gave a blood alcohol reading of 80.

A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both was withdrawn on May 23.

Fined for impaired driving

Romulo Julom, 46, of Wolfville, has been fined for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours of ceasing to operate a conveyance.

Julom pleaded guilty to the charge on May 23. Judge Ronda Van Der Hoek fined Julom $2,500 and imposed a one-year driving prohibition against him.

Julom committed the offence in Wolfville on Nov.

17, 2022. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Julom gave blood alcohol readings of 220 and 220.

A charge of operating a conveyance while his ability to do so was impaired by alcohol was withdrawn on May 23.

Mitchell Bruce Keddy, 37, of Berwick, has been fined for operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both.

Keddy changed his plea to guilty on May 23. Judge Ronda Van Der Hoek fined Keddy $1,500 and imposed a one-year driving prohibition against him.

Keddy committed the offence in Kentville on Aug. 26, 2022. A charge of having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours of ceasing to operate a conveyance was dismissed on May 23.
