CONDITIONAL SENTENCE WITH HOUSE ARREST

Kerry Lee Sampson, 37, of Windsor, will serve a period of imprisonment in the community after pleading guilty to three charges.

They include failing to comply with a condition of an undertaking, to not consume alcoholic beverages except within the confines of his own home and to not be outside his home while under the influence of alcohol; failing to comply with a condition of a release order, to not consume alcoholic beverages except within the confines of his own home and to not be outside his home while under the influence of alcohol; and resisting a peace officer engaged in the execution of his duty.

Sampson pleaded guilty or changed his pleas to guilty on Aug. 11 and 24, 2022. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing. On Aug. 11, 2022, a charge of assault was dismissed with the Crown offering no evidence.

On March 1, Judge Christopher Manning handed Sampson a 90-day conditional sentence order on the three charges. The conditional sentence includes house arrest for the first 45 days, to be followed by daily curfew from 9 p.m. to 6 a.m. for the remaining time. The conditional sentence will be followed by 12 months of probation.

Sampson committed the offences in Dartmouth on Sept. 14, 2020, and Oct. 17, 2021. Another count of resisting a peace officer engaged in the execution of his duty; a charge of obstructing a peace officer engaged in the execution of his duty; and a charge of committing mischief by willfully damaging the door of a RCMP police cruiser were dismissed on March 1.

UNDERTAKING, RELEASE ORDER OFFENCES

Gerald William Corbin, 45, of Berwick, will serve a period of imprisonment in the community after pleading guilty to charges of failing to comply with a condition of an undertaking and failing to comply with a condition of a release order.

Corbin changed his pleas to guilty on Feb. 23. The matters were adjourned to March 7 for sentencing.

Judge Christopher Manning handed Corbin a 60-day conditional sentence order, with house arrest for the entire time, on the two charges.

Corbin committed the offences in Kentville on May 8 and 13, 2022. Another count of failing to comply with a condition of an undertaking and another count of failing to comply with a condition of a release order were dismissed on March 7.

BREAK AND ENTER, UTTERED DEATH THREAT

Travis Darrell Seyforth, 35, of Lake Paul, has been sentenced to time deemed served and probation for breaking and entering into a shed with intent to commit an indictable offence therein; and for uttering a death threat to a police constable.

Seyforth was present in provincial court, in custody, on March 6. He re-elected provincial court and changed his pleas to guilty on both charges.

Judge Christopher Manning sentenced Seyforth to 348 days in custody, deemed served. Seyforth was given credit at time-and-a-half for 231 days spent remanded in custody. Seyforth was also sentenced to 18 months of non-reporting probation.

Seyforth committed the offences in St. Croix on July 18, 2022.

FINED FOR IMPAIRED DRIVING

Mitchell Don Zinck, 41, of Cambridge, Kings County, has been fined for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours of ceasing to operate a conveyance.

Zinck changed his plea to guilty on March 1. Judge Christopher Manning fined Zinck $1,000 and imposed a one-year driving prohibition against him.

Zinck committed the offence in Kingston on July 2, 2021. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Zinck gave blood alcohol readings of 100 and 90.

A charge of operating a conveyance while his ability to do so was impaired by alcohol was dismissed on March

1.

CONDITIONAL DISCHARGE FOR ASSAULT

Jeffrey Bowlby, 47, of Greenwood, has been handed a conditional discharge with probation for committing an assault.

Bowlby changed his plea to guilty on Jan. 18. The matter was adjourned to March 1 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Christopher Manning handed Bowlby a conditional discharge with 12 months of probation.

Bowlby committed the offence in Greenwood between Sept. 1, 2020, and Sept. 5, 2021. Two more counts of assault; a charge of choking a person in committing an assault, and two counts of failing to comply with a condition of an undertaking were dismissed on March 1.

SUSPENDED SENTENCE FOR ASSAULT

Gail Eileena Hill, 63, of Cambridge, Kings County, has been handed a suspended sentence with probation for committing an assault.

Hill pleaded guilty to the charge on Dec. 20, 2022. The matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

On March 1, Judge Christopher Manning handed Hill a suspended sentence with 12 months of probation.

Hill committed the offence in Cambridge on Sept. 14, 2022.

ASSAULT LEADS TO CONDITIONAL DISCHARGE

Zoe Frances-Clare, 23, of Wolfville, has been handed a conditional discharge with probation for committing an assault.

Frances-Clare changed her plea to guilty on Aug.

22, 2022. The matter was adjourned to allow time for a Gladue report to be prepared, for a sentencing circle at Glooscap First Nation to be scheduled, and for sentencing.

On March 1, Judge Christopher Manning handed Frances-Clare a conditional discharge with nine months of probation.

Frances-Clare committed the offence in Wolfville on June 24, 2021.

ASSAULT LEADS TO SUSPENDED SENTENCE

Evan Wayne Morine, 27, of Windsor, has been handed a suspended sentence with probation for committing an assault.

Morine changed his plea to guilty on Dec. 20, 2022. The matter was adjourned to March 6 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Ronda Van Der Hoek handed Morine a suspended sentence with 12 months of probation.

Morine committed the offence in Windsor on Jan. 23, 2022. Charges of choking, suffocating, or strangling an individual in committing an assault and uttering a death threat were dismissed on March 6 with the Crown offering no evidence.

TIME DEEMED SERVED, PROBATION

Angela Diane Durling, 53, of Greenwood, has been sentenced to time deemed served and probation for two counts of failing to attend court as directed by a judge.

Durling pleaded guilty to the charges on Dec. 20, 2022. The matters were adjourned to March 6 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Christopher Manning sentenced Durling to one day in custody deemed served and 12 months of probation on each count, to be served concurrently.

Durling committed the offences in New Minas on March 17, 2020, and in Kentville on Feb. 10, 2021.
