BREATHALYSER OFFENCE

Robert Patrick Riley, 30, of Kentville, has been sentenced to jail time for having a blood alcohol concentration that was equal to or exceeded the legal limit within two hours after ceasing to operate a conveyance.

Riley changed his plea to guilty on Jan. 20. The matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. On April 22, Judge Christopher Manning sentenced Riley to 120 days in custody, to be followed by two years of probation. The court imposed a three-year driving prohibition against Riley.

Riley committed the offence in Port Williams on Feb. 5, 2020. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Riley gave breathalyser readings of 120 and 120.

A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both was withdrawn on April 22.

CONDITIONAL SENTENCE WITH HOUSE ARREST

Nicholas Keith Harris, 27, of New Minas, has been handed a conditional sentence order with house arrest and has been sentenced to probation for various offences, including uttering a threat to cause bodily harm to an individual via text message; committing mischief by willfully urinating on the walls and floor of a New Minas RCMP prisoner cell and uttering a threat to cause bodily harm or death to an individual via Facebook message.

Harris has also been handed a suspended sentence with probation for possessing stolen property, a Giant Talon bicycle of a value not exceeding $5,000, and has been fined for failing to comply with his undertaking.

Harris pleaded guilty to the charges of uttering a threat via text message; mischief, possession of stolen property and uttering a threat via Facebook message on Jan. 27. He changed his plea to guilty to the undertaking charge on March 18. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

On April 22, Judge Christopher Manning handed Harris a 60-day conditional sentence order with house arrest for the entire time, to be followed by 18 months of probation, for uttering a threat via text message, committing mischief and uttering a threat via Facebook message.

Harris was handed a suspended sentence with 18 months of probation, to be served concurrently, for possessing stolen property. He was fined $50 for failing to comply with his undertaking.

As part of his probation, Harris has been ordered to pay $803.85 in restitution to an individual concerning the possession of stolen property charge.

Harris committed the offences in New Minas between Nov. 20, 2019 and March 16, 2020; between March 6 and 18, 2020; between June 19 and 28, 2020; and on July 11, 2020.

Another count of failing to comply with his undertaking was dismissed on April 22.

CONDITIONAL SENTENCE WITH HOUSE ARREST

Joshua Emino, 22, of West Northfield, Lunenburg County, has been handed a conditional sentence order with house arrest and has been sentenced to probation for committing an assault causing bodily harm.

Emino pleaded guilty to the charge on Jan. 12. The matter was adjourned to April 22 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Ronda Van Der Hoek handed Emino an eightmonth conditional sentence order, including house arrest for the first three months, to be followed by a daily curfew from 10 p.m. to 6 a.m. for the next three months. Emino was also sentenced to 12 months of reporting probation.

The court imposed a fiveyear firearms prohibition against Emino and granted a forfeiture order for a knife.

Emino committed the offence in White Rock between Aug. 29 and 30, 2019. Charges of committing an aggravated assault by wounding an individual; possessing a weapon for a purpose dangerous to the public peace and uttering a threat to burn an individual’s house were dismissed on April 22.
