Man pleads guilty to breach of undertaking

SUMMERSIDE – A 34-yearold Summerside man ended up with a suspended sentence after he was found with someone he was ordered to stay away from.

Osbourne Kermit Smith pleaded guilty in Summerside provincial court recently to breaching an undertaking.

The undertaking ordered Smith to stay away from two individuals, was from March 30, but on April 17 at 2:25 a.m., Summerside police officers saw Smith in a car with one of the people at a traffic stop.

Smith was arrested and released on another undertaking.

Smith said he is “willing to do the right thing”.

“I have two kids; I want to do the right thing,” said Smith.

Judge Krista MacKay suspended passing of sentence and place Smith on probation for 12 months.

He must continue to stay away from the same two people.
